Terms of Service

These Terms of Service ("Terms") govern your use of the TaskHammer website and mobile application (the "Service") operated by TaskHammer LLC ("TaskHammer," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

TaskHammer is a platform that helps homeowners manage home improvement projects. We connect you with local vendors, facilitate the collection of bids, and help coordinate project completion. TaskHammer acts as a facilitator — we are not a contractor, and vendors are independent third parties.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Your Account

• You are responsible for maintaining the security of your account credentials
• You agree to provide accurate and complete information
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Submit false, misleading, or fraudulent project information
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to harass, abuse, or harm vendors or other users
• Circumvent the Service to transact directly with vendors contacted through TaskHammer

5. Projects and Vendors

• TaskHammer facilitates connections between homeowners and vendors but does not guarantee the quality, safety, or legality of any vendor's work
• You are responsible for evaluating vendors and bids before accepting them
• Any contract for work is between you and the vendor — TaskHammer is not a party to that agreement
• We do not guarantee that vendors will be available or that bids will be provided for every project

6. Payments

Certain features of the Service may involve payments. By making a payment through the Service, you agree to our payment terms and authorize us to charge your selected payment method. All fees are stated at the time of transaction.

7. SMS Messaging

TaskHammer may send SMS messages to users who have opted in through our vendor signup page or mobile application. By opting in, you consent to receive text messages from TaskHammer related to the services you signed up for, including bid requests, scheduling confirmations, appointment reminders, job status updates, and platform notifications.

Message frequency varies based on your activity and job availability in your selected service areas. Message and data rates may apply depending on your mobile carrier and plan. TaskHammer is not responsible for any fees charged by your carrier for receiving text messages.

You may opt out of SMS messages at any time by replying STOP to any message from TaskHammer. After opting out, you will receive a one-time confirmation message and no further SMS messages unless you re-subscribe. You may reply HELP to any message for assistance or contact us at support@taskhammer.com.

Opting out of SMS does not terminate your TaskHammer account. You may continue to use the platform and receive communications through other channels such as email or push notifications.

TaskHammer does not share, sell, or provide your phone number or SMS consent data to third parties or affiliates for their marketing purposes. For details on how we handle your data, see our Privacy Policy.

8. Intellectual Property

The Service and its content, features, and functionality are owned by TaskHammer LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

9. User Content

You retain ownership of content you submit (photos, descriptions, etc.). By submitting content, you grant TaskHammer a non-exclusive, worldwide, royalty-free license to use, display, and share that content as necessary to operate and improve the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TASKHAMMER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTIES REGARDING THE QUALITY, RELIABILITY, OR AVAILABILITY OF ANY VENDORS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TASKHAMMER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM VENDOR WORK, PROPERTY DAMAGE, OR PERSONAL INJURY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO TASKHAMMER IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless TaskHammer LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
